CORPORATE AND COMMERCIAL LAW:
- Drafting of a settlement agreement, specific commercial and corporate advice on matters relating to intellectual rights and claims, separation of powers and financial compliance for SAMRO.
- Provided services on specific commercial contract advise on trademark matters for the SABC.
- Drafting and reviewing contracts for FoodBev.
CONSTRUCTION LAW:
Acted for Fast Forward Close Corporation in an urgent application against the Ekurhuleni Local Municipality to preserve the client’s rights pending adjudication of a contractual dispute. Furthermore, assisted the client to refer the matter for adjudication in terms of JBCC Nominated/ Selected Subcontract Agreement Edition 6.2.
LEGAL OPINIONS:
1. City of Ekurhuleni and Lesedi Municipality
Provided due diligence assessment on labour relations matters/ review of awards to advise on (Appealing, revoking or taking any other action that may bring about savings for municipalities.
2. SprintHive (Pty) Ltd
Provided legal opinion regarding the implications of legislation governing the protection of personal information in context of them compiling a public presentation on identity theft and fraud which is encountered by financial institutions when individuals apply for credit or establishing a relationship with those institutions.
3. National Library of South Africa
Determining whether the Memorandum of Incorporation (MOI) or the Board Charter should govern the process of filling current board vacancies, in light of discrepancies between the two documents, with specific reference to compliance with the Companies Act, the King IV Report on Corporate Governance, and overall corporate governance best practices.
4. Central Energy Fund
Drafted a legal opinion on the separation of powers between the Board and the Group CEO regarding the authority to take disciplinary measures against board-appointed officials
FORENSIC INVESTIGATIONS:
1. Competition Commission
Investigation and prosecution of cartel cases as well as cases of overbilling.
2. City of Mbombela
Investigation into irregular expenditure , world cup procurement-stadium development, tender irregularities and municipal infrastructure projects.
LABOUR LAW:
1. Department of Cooperative Governance and Traditional Affairs
Conducted due diligence assessment on the existing labour relations matters and provided opinions there on. These cases vary from unfair labour practices, unfair dismissals to salary disparities amongst others. Investigation and prosecution of cartel cases as well as cases of overbilling.
2. Merck Sharp & Dohme (MSD)
Provided legal services on labour related matters brought by their former employees.
3. Government Employees Pension Fund
Represented the GEPF in various labour disputes, including those that proceeded to the Commission for Conciliation, Mediation and Arbitration (CCMA) and other adjudicative forums.
